What equal protection means
"No State shall … deny to any person within its jurisdiction the equal protection of the laws."Fourteenth Amendment, U.S. Constitution
Equal protection means the laws that protect one person protect every person. A state can't decide that some people are covered by its homicide laws and others aren't.
02
Is a preborn child a person?
Alabama has already answered that question. State law defines a person as:
"a human being, including an unborn child in utero at any stage of development, regardless of viability."Alabama Code §13A-6-1
Even the Supreme Court saw where personhood leads. In Roe v. Wade, the Court wrote that if personhood were established, the case for abortion "collapses, for the fetus' right to life would then be guaranteed specifically by the Amendment."
03
Follow the Golden Rule
Jesus called "love your neighbor as yourself" the second greatest commandment (Matthew 22:39). Equal protection asks nothing more of our laws: treat the preborn neighbor the way we would want to be treated.
04
The duty to do justice
"Defend the poor and fatherless: do justice to the afflicted and needy."Psalm 82:3
Scripture calls civil rulers God's servants to punish evil (Romans 13:3–4), and charges them to deliver the oppressed and shed no innocent blood (Jeremiah 22:3). No one is more innocent or more defenseless than a child in the womb.
The solution
What the Equal Protection Act does
It repeals the provision that says abortion is not murder in Alabama, so preborn children are protected by the same homicide laws that protect everyone else. No new categories, no exceptions.
