Something is changing in state capitols across America.

In 2026, 16 bills to abolish abortion and give preborn children equal protection were active in state legislatures. Twelve of them were filed for the first time this year.

According to our friends at the Foundation to Abolish Abortion, 130 state lawmakers sponsored or cosponsored these bills, up from 122 in 2025.

Not long ago, few elected officials would touch the idea of treating abortion as the killing of a person. Today, lawmakers across the country are filing bills that do exactly that.

Where Things Stand

None of these bills has become law yet. But several states made history this year.

  • Idaho: 29 lawmakers signed on, a national record, up from 18 in 2025.
  • Oklahoma: 26 lawmakers signed on, up from just 7 in 2025.
  • South Carolina: The first equal protection bill ever filed in the state Senate.
  • South Dakota: The state’s first equal protection bill, which received a committee hearing.
  • Tennessee: The state’s first equal protection bill, which also received a committee hearing.
  • Illinois: The state’s first equal protection bill.

The question is no longer whether equal protection will be debated. It’s which state will pass it first.

Alabama Has Already Done the Hard Part

Alabama has been part of this fight from the start. Equal protection bills were filed in our state in 2023 and again in 2025. Both times, they died in committee without a vote.

But Alabama has an advantage few other states have. Our homicide law already defines a person as a human being “including an unborn child in utero at any stage of development, regardless of viability.”

The groundwork is laid. What’s missing is the will to finish the job by repealing the provision that says abortion is not murder.

Help Us Build Momentum for the Next Session

Every name on the petition and every call to a legislator adds pressure in Montgomery. With every seat in the legislature on the ballot this November, now is the time to make sure every member and every candidate knows where Alabamians stand.

Ask your state representative and senator one question: Will you cosponsor the Equal Protection Act?

Your donation helps us keep that question in front of every lawmaker in Montgomery.
